Users are prohibited from submitting, publishing or otherwise disseminating to or through the Site any content that defames, libels or invades the privacy of any individual, is obscene, pornographic, visually disturbing, abusive, or threatening, infringes any intellectual property rights, infringes the rights of any person, violates any law, advocates or describes any illegal activity, advertises any goods or services, or solicits funds.  2foods may disclose the identity of any User who violates the Terms in order to cooperate with law enforcement authorities and/or enforce our rights.    

Disseminating Harmful Content Is Not Allowed

Users are prohibited from disseminating any harmful content through use of the Site or any services accessed through the Site.  The following are considered harmful content: computer and electronic viruses, Trojan horses, electronic worms, time bombs, zombies, cancel bots, and any computer programming routines that may damage, interfere with, surreptitiously intercept or expropriate any system, program, data or personal information. The dissemination of any computer code on the Site or any services accessed through the Site is prohibited without the prior written consent of 2foods.  

Liability Is Limited

Use of the Site and any services provided through it is at User’s own risk.  2foods (including any of its directors, officers, employees, agents, contractors, and/or suppliers) is not liable for any direct, special, punitive, exemplary, incidental, indirect or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits, or loss of data, whether in an action in contract, tort (including, but not limited to negligence), or otherwise, arising out of or in any way connected with the use or inability to use the services on the Site.  In no event shall the aggregate liability of 2foods, whether in contract, warranty, tort (including but not limited to negligence), product liability, strict liability or other theory, arising out of or relating to use of the services on the Site exceed any amounts paid by User through the Site in the 12 months prior to the relevant claim(s).  Some jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of incidental or consequential damages, so some or all of the above disclaimers of liability may not apply to some Users, and some Users may have rights additional to those contained herein.

Consent to Email Communication 

Users who communicate with 2foods electronically (such as by sending an email or sending a message via the Site) consent to receive communications from 2foods electronically and agree that 2foods may communicate by email or by posting a notice on the Site.  

Right to Terminate Permission 

2foods reserves the right, without notice and in its sole discretion, to terminate User’s right to use any services provided through the Site and to block or prevent future access to and use of the services if User violates any of these Terms. Even if 2foods terminates User’s right to use the services, the Terms to which User agreed by using the Site will survive and remain in effect.

Applicable Law, Jurisdiction and Venue

By accessing the Site, User agrees that all matters relating to these Terms and access of the Site and its services will be governed by the laws of the State of California, without regard to any conflict of law provisions. Regardless of where the Site is accessed, User agrees that any action at law or in equity arising out of or relating to these Terms shall be filed and adjudicated only in the federal or state courts located in San Jose, California, and User hereby irrevocably and unconditionally consents and submits to the exclusive jurisdiction and venue of such courts over any suit, action or proceeding arising out of these Terms.

Severability

If any provision of the Terms is found to be unlawful, void, or for any reason unenforceable, then such provision shall be deemed to be severed from the rest of these Terms and shall not affect the validity and enforceability of any remaining provisions.
